This Acceptable Use Policy (“AUP”) governs the use of Praedium Insights LLC’s cloud-based real estate software platform (the “Services”). This AUP is incorporated by reference into the Software as a Service Subscription Agreement (“Agreement”) and Terms & Conditions. By accessing or using the Services, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of access.
1.Purpose
This AUP establishes guidelines for acceptable and prohibited conduct to:
- Protect the integrity and security of the Services
- Ensure compliance with MLS rules and real estate regulations
- Safeguard the privacy and rights of all users
- Maintain a professional environment for real estate professionals
2.Acceptable Use
You MAY use the Services to:
2.1 CRM and Contact Management
- Store and manage client and prospect contact information
- Track communications, tasks, and follow-ups
- Organize leads and opportunities
- Document transaction notes and activities
2.2 Listing and Property Management
- Access and display MLS listings per MLS rules
- Create reports from listing data (automated Comparative Market Analysis (CMA) generation is planned but not yet available)
- Share property information with clients (with proper attribution)
- Track listing activity and market data
2.3 Business Operations
- Manage brokerage and agent workflows
- Generate reports and analytics for business purposes
- Communicate with clients via integrated email (Gmail)
- Automate legitimate business processes (workflow automation is planned but not yet available)
2.4 Collaboration
- Share appropriate information with team members
- Coordinate with transaction parties
- Communicate with clients and prospects professionally
3.Prohibited Conduct
You may NOT use the Services to:
3.1 Illegal Activities
- Violate any federal, state, or local law or regulation
- Engage in fraud, misrepresentation, or deceptive practices
- Violate real estate licensing laws or regulations
- Facilitate money laundering or other financial crimes
- Discriminate in violation of fair housing laws
3.2 MLS and Data Violations
- Use MLS data outside of permitted purposes
- Redistribute, resell, or publicly display MLS data without authorization
- Scrape, harvest, or bulk download MLS data
- Remove or alter MLS attribution or disclaimers
- Share MLS credentials with unauthorized users
- Access MLS data for unlicensed individuals
- Violate IDX, VOW, or other MLS display rules
3.3 Privacy and Data Misuse
- Collect personal information without proper consent
- Use contact data for purposes not disclosed to contacts
- Share client information without authorization
- Sell or transfer contact lists to third parties
- Access another user’s account without permission
- Circumvent access controls or security measures
3.4 Spam and Unsolicited Communications
- Send unsolicited bulk emails or messages
- Violate CAN-SPAM, TCPA, or other communication laws
- Use the Services for telemarketing without consent
- Harvest email addresses or phone numbers for spam
- Send deceptive or misleading communications
3.5 Harmful Content
- Upload malware, viruses, or malicious code
- Transmit content that is defamatory, obscene, or harassing
- Post false or misleading property information
- Impersonate another person or entity
- Infringe on intellectual property rights
3.6 System Abuse
- Attempt to gain unauthorized access to systems or data
- Interfere with or disrupt the Services
- Reverse engineer, decompile, or extract source code
- Use automated tools to access the Services without permission
- Overload systems with excessive requests
- Probe, scan, or test system vulnerabilities
- Bypass rate limits or usage restrictions
3.7 Misrepresentation
- Misrepresent your identity, licensing status, or brokerage affiliation
- Falsely claim ownership of listings
- Misrepresent property information or transaction details
- Create fake accounts or profiles
- Use another agent’s or brokerage’s identity
3.8 Competitive Misuse
- Use the Services to develop a competing product
- Benchmark the Services for competitive purposes without consent
- Solicit Praedium employees or contractors
- Disparage the Services or Praedium publicly with false information
4.MLS Compliance Requirements
Users with access to MLS data must:
4.1 Display Requirements
- Include all required MLS disclaimers and attribution
- Display listing broker attribution as required
- Include last-updated timestamps on listing displays
- Follow IDX/VOW display rules as applicable
4.2 Data Handling
- Use MLS data only for permitted purposes (CRM, CMA, client service)
- Not store MLS data beyond permitted retention periods
- Delete MLS data upon license termination or as required
- Cooperate with MLS audits and compliance requests
4.3 Access Control
- Not share MLS access credentials
- Ensure only licensed/authorized users access MLS data
- Report suspected MLS data breaches immediately
- Maintain accurate MLS participant/subscriber status
5.Security Requirements
Users must:
5.1 Account Security
- Use strong, unique passwords
- Enable two-factor authentication when available
- Not share login credentials
- Log out from shared or public devices
- Report suspected account compromises immediately
5.2 Data Protection
- Protect client and contact information appropriately
- Not store sensitive data (SSN, financial accounts) in the Services
- Follow brokerage data security policies
- Report data breaches or suspicious activity
5.3 Device Security
- Keep devices and browsers updated
- Use secure networks when accessing the Services
- Not access the Services from compromised devices
6.Content Standards
All content uploaded or transmitted through the Services must:
- Be accurate and not misleading
- Not infringe on third-party intellectual property
- Not violate any person’s privacy rights
- Comply with fair housing and anti-discrimination laws
- Be professional and appropriate for business use
7.Reporting Violations
7.1 How to Report
Report suspected violations to:

- Evidence or documentation
- Your contact information
7.2 Investigation
Praedium will:
- Investigate reported violations promptly
- Take appropriate action based on findings
- Maintain confidentiality where appropriate
- Cooperate with law enforcement when required
8.Enforcement
8.1 Consequences of Violation
Violations of this AUP may result in:
- Warning and request for corrective action
- Temporary suspension of access
- Permanent termination of account
- Reporting to MLS or regulatory authorities
- Legal action where appropriate
8.2 Factors Considered
When determining enforcement action, Praedium considers:
- Severity of the violation
- Whether the violation was intentional
- Impact on other users or third parties
- History of prior violations
- Cooperation with investigation
8.3 Right to Suspend
Praedium reserves the right to suspend access immediately, without prior notice, for:
- Serious or ongoing violations
- Security threats
- Legal or regulatory requirements
- MLS compliance issues
9.Changes to This Policy
Praedium may update this AUP from time to time. Material changes will be communicated through the Services or via reasonable notice. Continued use of the Services after changes constitutes acceptance.
